Fixing Busted Trusts In Oregon and Washington
Irrevocable trusts are foundational estate planning tools; they are used for tax planning, asset protection, helping beneficiaries with special needs, and many other purposes. However, when circumstances change after an irrevocable trust is created, conflict (and sometimes litigation) can follow. Fortunately, both Oregon and Washington law provide options for modifying (and in some cases terminating) trusts that no longer function as they were intended. This presentation will discuss those options, including the use of TEDRA agreements and NJSAs, decanting and judicial remedies, and will compare the pros and cons of each of those options.
